Welcome to Wax Assault Records (the "Site," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website and online store hosted on Shopify, including the purchase of physical products such as vinyl records, merchandise, and related items.

By visiting our Site and/or purchasing something from us, you agree to be bound by these Terms. If you do not agree, you may not access the Site or use any services.

1. About Wax Assault Records

Wax Assault Records is an independent record label specializing in limited-edition vinyl, CD, and cassette releases. We also offer related merchandise, including apparel and accessories. All products sold are physical items unless explicitly stated otherwise.

2. Eligibility

You must be at least the age of majority in your state or country of residence to use this Site. By using the Site, you represent that you meet this requirement.

3. Products & Availability

  • All releases are limited quantities unless otherwise stated.

  • Product descriptions, images, and specifications are provided to the best of our ability but may vary slightly from the final manufactured product.

  • We reserve the right to limit or cancel quantities purchased per order.

  • Preorders are subject to manufacturing timelines and delays outside of our control.

  • Products and services may not be available in all locations, and any offer is void where prohibited.

  • Wax Assault Records makes no representations regarding resale value, collectability, or future availability of any product.

4. Preorders

  • Preorder items are not in stock at the time of purchase.

  • Estimated ship dates are not guaranteed and may change due to pressing plant delays, revisions, or shipping disruptions.

  • Orders containing both preorder and in-stock items will ship together once all items in the order are available. Customers who wish to receive in-stock items sooner must place separate orders.

  • Preorder items are typically non-cancellable. Cancellation requests may be considered solely at the discretion of Wax Assault Records. Any approved cancellation may be subject to a processing fee of up to 10% of the order value to cover non-refundable payment processing and administrative costs.

5. Pricing & Payments

  • Prices are displayed in the local currency based on your location or selected market. All transactions are processed in U.S. Dollars (USD) or the local currency presented at checkout, as determined by Shopify.

  • The currency displayed at checkout is the currency in which you will be charged. Please note that your bank or credit card company may charge additional fees or apply a different conversion rate to your payment, for which we are not responsible.

  • Prices do not include shipping, taxes, duties, or customs fees unless explicitly stated.

  • We reserve the right to change prices at any time without notice.

  • Payment must be received in full before an order is processed.

6. Order Changes, Address Changes & Cancellations

  • Orders are processed quickly and cannot be modified once placed. Customers are responsible for ensuring that all order details, including shipping address and selected items, are correct at the time of checkout.

  • Requests to change a shipping address after an order is placed are not guaranteed. Shipping rates are calculated based on the address provided at checkout. If a requested address change results in higher shipping costs, the customer is responsible for paying the difference prior to shipment.

  • If additional shipping charges are not paid, the order will ship to the original address provided at checkout.
  • Any other request to modify an order may be treated as a cancellation request. Orders are not guaranteed to be cancellable once placed. Cancellation requests for orders that have not yet shipped may be considered at the sole discretion of Wax Assault Records and, if approved, may be subject to a processing fee of up to 10% of the order value to cover non-refundable payment processing and administrative costs.

7. Shipping

  • We ship from the United States unless otherwise noted.

  • Shipping costs are calculated at checkout.

  • Delivery times are estimates only and not guaranteed.

  • Customers are responsible for providing accurate and complete shipping information. Wax Assault Records is not responsible for orders delayed, lost, or returned due to incorrect or incomplete addresses provided by the customer.

  • All orders are deemed shipped and fulfilled once handed to the shipping carrier. Title and risk of loss transfer to the customer at that time. Fulfillment does not require delivery to the customer.

  • Wax Assault Records is not responsible for loss, theft, delay, or damage that occurs during transit, including but not limited to carrier mishandling, customs inspection, or weather-related incidents.

  • Once tracking shows an order has been successfully delivered, Wax Assault Records is not responsible for lost or stolen packages. Customers should contact the shipping carrier to file a claim.

8. International Orders

  • International customers are responsible for all customs duties, VAT, import taxes, and brokerage fees.

  • Wax Assault Records is not responsible for damage caused by customs inspections or border handling.

  • Refused or unclaimed packages are not eligible for refunds.

9. Returns & Refunds

All sales are final. Refunds or replacements are not guaranteed and may be issued, if at all, solely at the discretion of Wax Assault Records. We accept replacements or refunds only in the following cases:

  • Manufacturing defects that render a product materially unplayable

  • Incorrect items shipped by Wax Assault Records

Wax Assault Records does not offer refunds or replacements for:

  • Damage incurred during shipping

  • Lost or stolen packages

  • Damage caused by customs inspections, border handling, or other government authorities

  • Seam splits, corner dings, jacket wear, damage to vinyl jackets or sleeves, or other cosmetic damage

  • Minor vinyl imperfections, surface noise, or color variation

  • Buyer’s remorse or preference-based concerns

Claims for manufacturing defects or incorrect items must be submitted within 7 days of delivery and must include photographic evidence. Determination of whether an item is defective is made at the sole discretion of Wax Assault Records. For confirmed defects, Wax Assault Records will provide a replacement at no additional cost. Return of the defective item is not required.

Refunds, if approved, will be issued to the original payment method. Refunds are issued only when a replacement is not available. Original shipping charges are non-refundable.

Digital Products: All sales of digital goods (including but not limited to downloads, streaming access, or digital album codes) are final and non-refundable.

10. Vinyl Manufacturing Disclaimer

Due to the nature of vinyl production:

  • Minor surface noise, color variation, and cosmetic imperfections are normal.

  • Minor warping that does not affect playback is normal.

Such characteristics do not constitute defects. By purchasing vinyl records from Wax Assault Records, you acknowledge and accept these industry‑standard conditions.

11. Intellectual Property

All content on this Site - including logos, text, images, layouts, and branding is the property of Wax Assault Records or its licensors and may not be used without prior written consent.

Audio recordings remain the property of their respective rights holders and are sold under license.

12. Prohibited Uses

You may not use the Site or its content:

  • For unlawful purposes

  • To infringe upon intellectual property rights

  • To transmit malicious code or spam

  • To interfere with the Site’s security or functionality

We reserve the right to terminate access for violations.

13. Third‑Party Services

Our store is hosted on Shopify and may integrate with third‑party services. We are not responsible for third‑party content, policies, or practices.

14. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied.

15. Limitation of Liability

To the fullest extent permitted by law, Wax Assault Records shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Site or products purchased.

16. Indemnification

You agree to indemnify and hold harmless Wax Assault Records from any claims arising out of your breach of these Terms or misuse of the Site.

17. Assignment

Wax Assault Records may assign these Terms without restriction. Customers may not assign their rights without prior written consent.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict‑of‑law principles.

19. Dispute Resolution

In the event of any dispute arising under these Terms, you agree to first contact Wax Assault Records directly to seek a resolution through informal negotiation. Any legal action or claim related to these Terms will be filed only in the state and federal courts located in the State of New York.

20. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

21. Entire Agreement; No Waiver

These Terms constitute the entire agreement between you and Wax Assault Records and supersede all prior or contemporaneous communications or agreements. Failure by Wax Assault Records to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

22. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes take effect upon posting to the Site.
